Questionnaire: Prenuptial Agreement

The following information will be needed to begin drafting documents for a prenuptial agreement. Additional information may be requested later by email. In addition to the information below, I’ll need a schedule of each party’s debts, assets and accounts, and approximate values for each. This can be sent via document or spreadsheet to adam@thelillylawfirm.com. I will also need proof of identity, such as a valid driver's license. Is there a chance the parties may have children *with each other*?

Shared Accounts

Will the parties be sharing primary bank accounts?

Separate Accounts

Will the parties maintain separate banking accounts (regardless of whether or not primary accounts are shared)?

Living Expenses

How will general living expenses - mortgage/rent, utilities, insurance, groceries, etc - be paid?

Counsel

Each party is advised to have the prenuptial agreement reviewed by independent counsel. Will both parties be doing so?

Decisions in the Event of Divorce

Separate Property

Typically, in the event of divorce, a party's separate property will not be subject to division by the court. Will the parties be agreeing to that here, or is some division of separate property agreeable?

Marital Property

Typically, in the event of divorce, all marital property is subject to division. If the parties agree, certain marital items may be agreed to be kept separate, such as retirement accounts and property purchased prior to the marriage by way of loan that is then fully or partially repaid during the marriage. Will any specific categories of marital property be kept separate in the event of divorce?

Marital Income

Income earned during the marriage is considered marital property. In the event of divorce, will each party be entitled to keep any unspent portion clearly from their own income?

Separate Debts

Typically, in the event of divorce any pre-existing debts are not disturbed by the court. Is there an intention to make any pre-existing debts marital responsibilities?

Marital Debts

Typically, any debts incurred during the course of the marriage are divided equitably in the event of divorce. Will you be agreeing to that, or to another arrangement (such as equally dividing jointly titled debts and each party keeping individually titled debts incurred during the marriage)?

Alimony

In the event of divorce, would either party be paying alimony to the other? If so, how much? How long? Are there any conditions that would terminate alimony obligations? Are there any circumstances that would preclude alimony?
